1.2. Eligibility
The service is available to users who are at least 18 years old. AdHeed is intended for both business entities and individual professionals. A user must be a member of an organization within the system in order to use the service. Users may create their own organization and be its sole member.
1.3. Governing Law
These Terms are governed by the laws of the Republic of Poland.
1.4. Definitions
For the purposes of these Terms of Use:
- Asset refers to any individual advertising creative (e.g., image, banner, or video) uploaded by the user for analysis in the AdHeed platform.
- Token is the unit used to process analysis requests. One asset analysis consumes 10 tokens. In the case of Bulk Asset Projects involving the analysis of multiple assets at once, the system deducts the corresponding number of tokens based on the total number of assets submitted.
- Report refers to the output generated by AdHeed’s system after an asset is analyzed using AI/ML models. Each report includes a prediction of visual attention and performance indicators based on the analyzed creative.
2. Description of the Service
2.1. What is AdHeed?
AdHeed is an advanced AI/ML tool designed for modern marketing and creative teams seeking to make data-driven decisions rather than relying on subjective judgments. The platform enables pre-testing and optimization of advertising creatives before a campaign launch.
AdHeed uses models simulating visual attention to forecast how audiences will react to your creative in different environments. This allows you to receive reliable and automated assessments of effectiveness prior to promotional deployment.
2.2. Subscription Model
AdHeed operates on a monthly subscription model (30 days), in which the user receives a specific token allocation based on the selected plan. Pricing plans are visible in the application and include:
- Starter – 40 tokens / month
- Basic – 100 tokens / month
- Pro – 300 tokens / month
- Enterprise – custom token volume, tailored to the client’s needs
One analysis costs 10 tokens (1 asset = 10 tokens). Once the token limit is reached, the user may upgrade to a higher plan. The upgrade is performed by purchasing the higher-tier plan at its full monthly price. The billing cycle is not reset – the user retains the billing period from the original subscription (e.g., if an upgrade occurs on day 15 of a 30-day cycle, the new plan remains active for the remaining 15 days).
All prices listed in the pricing table are net amounts (excluding VAT or applicable taxes). The final price may vary depending on your billing country and applicable tax rate.
Unused tokens do not carry over to the next billing period. Users cannot exceed their token quota.
2.3. Trial
New users are eligible for a 14-day free trial of the Starter plan, which includes 40 tokens (up to 4 asset analyses). The trial requires a valid payment method. Only one trial is permitted per user and per payment method.
2.4. Token Ownership
Tokens are assigned to an organization. Other members of the same organization may use the shared token pool.
2.5. One Active Subscription Per Organization
Each organization may have only one active subscription at a time.
3. Acceptable Use Policy
3.1. Prohibited Activities
You agree not to use the AdHeed platform to:
- Violate any applicable laws or regulations
- Attempt to gain unauthorized access to the platform or its data
- Use the platform in a way that may disrupt its normal operation or affect other users
- Misrepresent data or results produced by AdHeed as guaranteed or infallible
- Use the platform to promote disinformation, political manipulation, or deepfakes
- Bypass or attempt to exceed the usage limits defined by your subscription plan
3.2. Suspension or Termination
AdHeed reserves the right to suspend or terminate access to the service if a user violates these Terms, engages in abuse or fraud, or poses a security threat.
4. AI and Model Limitations
4.1. No Guarantees of Accuracy
The results provided by AdHeed are generated using machine learning models trained to simulate visual attention. While significant efforts have been made to ensure reliability and repeatability of results, the predictions are not guaranteed to be 100% accurate. Current internal evaluations indicate an accuracy level of approximately 90%.
4.2. No Guarantees of Campaign Effectiveness
AdHeed is a decision-support tool and has been tested in real-world campaign conditions. However, the platform does not guarantee the effectiveness or success of any campaign. Campaign outcomes may vary depending on a range of external factors, including the product or service being promoted, targeting strategy, media placement, and timing.
4.3. Limited Liability
To the fullest extent permitted by law, AdHeed and its team do not assume legal liability for business decisions, marketing results, or financial outcomes derived from use of the platform. The service is used entirely at the user’s own risk and discretion.
5. Cancellation and Data Retention
5.1. Cancellation and Refunds
Users may cancel their subscription at any time. The subscription remains active until the end of the current billing period. Subscription fees are non-refundable.
5.2. Post-Cancellation Access
After cancellation, users retain access to previously generated reports, but cannot create new analyses. Data will remain accessible until the user deletes their account or the organization is removed.
6. Technical Requirements
The use of the AdHeed Service requires:
- access to the Internet and a device capable of running a modern web browser,
- an active e-mail address,
- authentication via OAuth 2.0 (e-mail/password or Google login, provided via Auth0),
- a current version of a web browser, with Google Chrome recommended for optimal performance; the Service is also compatible with other Chromium-based browsers (e.g. Microsoft Edge) and Mozilla Firefox,
- the ability to upload graphic files in PNG or JPG/JPEG format.
7. Complaints Procedure
The Service Provider accepts complaints regarding the incorrect operation of the Service. Complaints should be submitted electronically by e-mail to contact@adheed.ai.
The complaint should contain at least:
- e-mail address for correspondence,
- a detailed description of the circumstances justifying the filing of the complaint and any claims.
- If the data provided in the complaint are incomplete and require supplementation, before considering the complaint, the Service Provider will ask the complainant to complete the complaint in the indicated scope.
- Correctly submitted complaints will be considered within 14 days from the moment the Service Provider receives the complaint.
- The response to the complaint will be sent to the correspondence address indicated in the complaint.
8. Privacy Policy
A separate Privacy Policy outlines how user data is collected, stored, and processed. The policy is available in the application and must be accepted separately.
9. Modifications to the Terms
AdHeed reserves the right to modify these Terms at any time. Updated Terms will be published in the application. Continued use of the service after changes have been made constitutes acceptance of the updated Terms.
