Privacy Policy

I. DEFINITIONS

Controller – AdHeed Sp. z o. o. with its registered office in Siedlce at Jana Kilińskiego street No. 7/4, 08-110 Siedlce, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Lublin, KRS No.: 0000870444, Tax Identification Number (NIP): 1133023590, REGON 387630793 (also: “AdHeed”).

Cookies – computer data, in particular text files, which are stored on the User’s terminal device and used for statistical purposes, to improve the functionality of the Website and other functions.

Personal Data – any and all the information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified directly or indirectly.

Policy – this Privacy Policy.

GDPR – Regulation 2016/679 (EU) of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

Website – a website operated by the Controller to provide Users with an advanced AI/ML tool called AdHeed that allows Users to pretest and optimize advertising creatives before the actual launch of marketing or advertising campaigns.

User – any natural person who has opened a User account on the Website and who uses Website functionalities.

III. THE PERSONAL DATA WE PROCESS

We collect and process the following data and information about the Users who use the Website:

  1. Personal data provided by the User when opening an account, and account information.
    • When opening an account on the Website, the User will be asked to provide an email address. User’s email address will be used for verifying their account when logging in for the first time. User’s email address is then stored by us to enable them to log in to their account on the Website. We process that data on the basis of Article 6(1)(b) GDPR for the entire period that the User has an account on the Website, and then for a period of 365 days after the User deletes their account on the Website (for that period, we process that data on the basis of Controller’s legitimate interest in securing information for the purpose of proving facts, as well as establishing, asserting or defending against claims resulting from Controller’s legitimate interest, i.e. on the basis of Article 6(1)(f) GDPR).
    • To order services on the Website, the account User must provide a valid payment method, including their name and other data necessary to make a payment. The data is processed by the Controller on the basis of Article 6(1)(b) GDPR for the entire period during which the User provides the data, and not longer than the period for which the User has an account on the Website. Provision of data by the User is not necessary to open a User account, but is necessary to use the services of the Website.      

Please be informed that provision of personal data by the User, referred to in point 1, is voluntary, but if they fail to do so, it will not be possible to open an account on the Website and use the Website.

  1. Content that the User posts on the Website and the analysis report ordered by the User via the Website.

We process that data on the basis of Article 6(1)(b) GDPR for the entire period that the User has an account on the Website, and then for a period of 365 days after the User deletes their account on the Website (for that period, we process that data on the basis of Controller’s legitimate interest in securing information for the purpose of proving facts, as well as establishing, asserting or defending against claims resulting from Controller’s legitimate interest, i.e. on the basis of Article 6(1)(f) GDPR).

Please be informed that we are not responsible for the content posted on the Website by the User.

IV. PERSONAL DATA RECIPIENTS

Personal Data may be shared:

  1. With Controller’s authorized employees and associates.
  2. With providers of services provided to the Controller, including with the operator of payments made on the Website (for this the Controller uses the services of the Stripe operator – the Stripe privacy policy is available at: https://stripe.com/en-pl/legal/cookies-policy).

 

V. RIGHTS OF THE DATA SUBJECT

The User has the right to access, rectify, erase or restrict processing of their personal data, as well as the right to object to processing based on Article 6(1)(f) GDPR, to transfer data to another data controller to the extent specified in Article 20 GDPR, subject, however, to the limitations of the rights under generally applicable laws.

In addition, the User has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that the Controller processes their personal data is in violation of the law.

VI. DATA TRANSFER OUTSIDE THE EEA

Data is not transferred outside the European Economic Area (EEA)

VII. COOKIES

The Controller uses the following Cookies on the Website:

  1. Essential (technical) cookies

These files are required for proper operation of the Website and do not require User’s consent.

  1. Analytical cookies (e.g. Google Analytics)

These cookies enable to collect anonymous statistical data about the use of the Website. They are activated only after obtaining permission from the User. This information does not identify a specific person.
